In the event of his being for any reason precluded from accepting it, I should then propose to offer it to Mr. Whyte who on former occasion acted during a long period as Judge of the Summary Court and has, therefore, in my opinion superior claims to Mr Hayllar, a barrister of less standing and a recent arrival in the Colony, and the only Practitioner whose Claims have not already been discussed.
The decision of the Government in this matter may entail important results, and I therefore ask the assistance of the Executive Councillors as possibly some of them may see some of the actions or suggest some better Course which may have escaped myself.

There can be no doubt that as stated in this memorandum the respect in which the Courts of Justice should be held has been very much diminished of late and that it is most desirable that in any appointment now made the person appointed should carry with him the feeling that the dignity of the Bench in his hands would be firmly and temperately maintained. In this respect Mr. Pauncefote's appointment would certainly be best, and I hope that his own pecuniary interests will not prevent his accepting it.
